Is a Data Transfer and Use Agreement needed for de-identified data?


Answer

Yes.  Identifiability does not have an impact on whether or not an agreement is needed to share or transfer data collected as part of a human subject research project. The IRB must review the transfer agreement, even if the data being shared is de-identified. The IRB is looking to ensure the consent form is consistent with what and how you want to share the data.
